BidMyBite is a digital marketplace that connects event organizers ("Event Hosts") with professional caterers ("Caterers"). We facilitate the bidding process and provide a platform for communication and transaction coordination. We are not a party to any agreements between Event Hosts and Caterers.

3. User Responsibilities

3.1 General Responsibilities

Provide accurate, current, and complete information during registration
Maintain the security of your account credentials
Comply with all applicable laws and regulations
Respect the rights and dignity of other users
Use the Platform only for lawful purposes

3.2 Caterer Responsibilities

Maintain all required licenses, permits, and insurance coverage
Comply with all food safety regulations and health department requirements
Provide services in a professional and timely manner
Ensure food quality and safety standards are met
Handle food allergies and dietary restrictions with appropriate care

3.3 Event Host Responsibilities

Provide accurate event details and requirements
Make timely payments as agreed upon with the Caterer
Provide safe and adequate venue facilities for catering services
Communicate any changes to event details promptly

4. Limitation of Liability and Disclaimers

4.1 Platform Disclaimer

BidMyBite operates solely as an intermediary platform. We do not provide catering services, prepare food, or host events. We are not responsible for the quality, safety, or delivery of catering services, food products, or event execution.

4.2 Food Safety and Health Disclaimer

Users acknowledge and agree that BidMyBite is not liable for any food-related illnesses, allergic reactions, food poisoning, or any health issues arising from consumed food or beverages. All food safety responsibilities rest solely with the Caterers and Event Hosts.

4.3 Behavioral Disclaimer

BidMyBite is not responsible for the conduct, behavior, or actions of any users, including but not limited to aggressive behavior, harassment, or any criminal activities. Users interact at their own risk.

4.4 Comprehensive Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIDMYBITE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES OBTAINED THROUGH THE PLATFORM.

5. Indemnification

You agree to indemnify, defend, and hold harmless BidMyBite, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

7. Payment and Fees

BidMyBite may charge service fees for the use of our Platform. All transactions between Event Hosts and Caterers are conducted independently, and we are not responsible for payment disputes or failures.

Users are responsible for all applicable taxes related to their use of the Platform and any transactions conducted through it.

8. Intellectual Property

All content, trademarks, and intellectual property on the Platform belong to BidMyBite or our licensors. Users may not reproduce, distribute, or create derivative works without express written permission.

9. Termination

We reserve the right to terminate or suspend your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will cease immediately.

10. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You waive your right to participate in class action lawsuits or class-wide arbitrations against BidMyBite.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
